These Terms of Use ("Terms") govern your access to and use of Lexi, including the Lexi mobile application, educational content, digital features, purchases, subscriptions, and related services (collectively, the "Service").
"Lexi", "Lexi Developers", "we", "us", and "our" refer to the developer and publisher responsible for Lexi, as identified on the storefront from which Lexi is distributed.
By downloading, installing, accessing, purchasing, or using Lexi, you agree to these Terms. If you do not agree, do not use Lexi.
Lexi is an educational application intended to assist users in learning English through vocabulary, associative learning, lessons, exercises, activities, and related functionality.
Lexi is a learning aid. Individual learning results depend on many factors outside our control.
We do not guarantee any particular level of language proficiency, vocabulary retention, pronunciation, examination result, academic outcome, employment result, or other educational outcome.
You may use Lexi only if your use is permitted under applicable law.
Where applicable law requires a minor to obtain permission from a parent or legal guardian, the minor may use Lexi only with that permission.
A parent or guardian who permits a minor to use Lexi is responsible for supervising that use to the extent permitted by applicable law.
Subject to these Terms and applicable app-store rules, Lexi Developers grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use Lexi for personal, lawful, non-commercial purposes.
No ownership rights in Lexi or its content are transferred to you.
You must not, except where applicable law expressly permits otherwise:
Lexi may provide certain lessons, features, repetitions, content, or usage without charge.
Free access may be subject to limits, including lesson limits, stamina, daily access limits, progression requirements, or other restrictions.
The nature and amount of free functionality may change as Lexi evolves, subject to applicable law.
Lexi may offer paid subscriptions, one-time purchases, premium access, or other paid digital functionality.
The exact functionality included with a purchase will be described in the app or applicable purchase screen.
Premium features may include removal or expansion of limits that apply to free use.
Lexi may offer automatically renewing subscriptions.
Before a purchase is completed, the applicable purchase interface will display the subscription price, billing period, and relevant offer terms.
An automatically renewing subscription continues for successive billing periods until cancelled in accordance with the rules of the platform through which it was purchased.
Your app-store account may be charged upon purchase and at subsequent renewals.
Lexi may offer free trials, introductory pricing, discounts, promotional access, or other offers.
Eligibility, availability, duration, and pricing may vary by user, storefront, platform, country, or previous subscription history.
Unless the purchase interface states otherwise, an automatically renewing subscription offered with a trial or introductory period may convert into the applicable paid subscription when that period ends unless cancelled before renewal.
Promotional offers may be modified or discontinued for future users at any time, subject to applicable law.
Subscriptions purchased through the Apple App Store or Google Play must generally be managed through the account and subscription-management tools provided by the applicable platform.
Deleting Lexi, ceasing to use Lexi, or deleting locally stored application data does not automatically cancel a subscription.
Unless applicable law or the relevant platform provides otherwise, cancelling an automatically renewing subscription prevents future renewals but does not necessarily terminate access for a subscription period that has already been paid for.
Prices may vary by platform, country, storefront, currency, taxes, promotions, and other factors.
Future subscription prices may change. Any price change affecting an existing subscription will be handled in accordance with the applicable platform rules and applicable law.
Payments made through Apple or Google are processed by the applicable platform.
Lexi Developers do not directly control the payment-processing systems operated by Apple or Google.
Your transaction may also be subject to the payment, billing, subscription, tax, and marketplace terms of the platform through which you purchased Lexi.
Refund rights are determined by applicable law and, where the transaction is processed by an app store, by the applicable app-store procedures and policies.
Where Apple or Google controls the transaction, a refund request may need to be submitted directly to Apple or Google.
Nothing in these Terms limits any refund right that cannot legally be excluded.

To the maximum extent permitted by applicable law, Lexi Developers may change, rebalance, add, remove, replace, increase, decrease, or otherwise modify:
Such changes may be made for balancing, technical, educational, commercial, security, legal, or operational reasons.
Nothing in this section permits Lexi Developers to disregard mandatory consumer rights relating to products or services already purchased.
Lexi may store certain progress locally on a device or use technical services to process certain information.
To the maximum extent permitted by law, Lexi Developers do not guarantee that all progress, streaks, achievements, settings, statistics, virtual items, or other locally stored information will always be preserved.
Information may be affected by device loss, device replacement, reinstallation, operating-system changes, storage failure, corrupted data, software defects, updates, or circumstances outside our reasonable control.
Users should not treat Lexi progression or virtual items as having independent monetary value.
We make reasonable efforts to provide useful educational material, but languages vary by region, dialect, context, formality, culture, and speaker.
Lexi may contain errors, omissions, alternative interpretations, pronunciation differences, or content that may not be appropriate for every context.
Educational content may be corrected, updated, replaced, or removed.
Lexi is not a certified language examination, accredited educational institution, professional translation service, or provider of legal, medical, financial, immigration, safety-critical, or other professional advice.
Lexi is an evolving product.
To the maximum extent permitted by applicable law, Lexi Developers may modify, update, redesign, suspend, replace, or discontinue features or portions of the Service.
We do not guarantee that any particular lesson, feature, interface, progression system, operating-system version, or device will remain supported indefinitely.
Software updates may be released to improve functionality, add or remove features, correct errors, address security issues, or maintain compatibility.
Certain versions of Lexi may stop functioning correctly if updates are not installed.
Lexi is provided subject to technical and operational availability.
The Service may become unavailable or operate incorrectly because of:
Continuous or error-free availability is not guaranteed.
Lexi may rely on third-party services, including Apple, Google, Google Analytics for Firebase, operating-system services, app-store services, payment systems, and technical infrastructure.
Lexi Developers do not control every aspect of independent third-party services and are not responsible for changes, outages, restrictions, acts, omissions, or failures of third parties outside our reasonable control.
You must comply with applicable third-party terms when using services connected with Lexi.
Lexi and its software, code, architecture, artwork, characters, graphics, animations, designs, user interface, sounds, recordings, educational materials, lessons, exercises, text, logos, trademarks, branding, databases, and other content are owned by or licensed to Lexi Developers and are protected by applicable intellectual-property laws.
Except for the limited license expressly granted in these Terms, all rights are reserved.
Nothing in these Terms grants permission to reproduce, distribute, commercialize, scrape, train systems on, extract, republish, or create derivative commercial products from Lexi content except where applicable law expressly provides otherwise.
If you voluntarily provide suggestions, ideas, comments, or feedback about Lexi, you agree that Lexi Developers may use that feedback without an obligation to compensate you, provided that doing so does not transfer ownership of personal information or other rights that cannot legally be transferred.
Access to Lexi may be restricted or terminated where reasonably necessary because of:

Information relating to the use of Lexi is handled as described in the Lexi Privacy Policy.
To the maximum extent permitted by applicable law, Lexi and the Service are provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, no warranty is made that:
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
To the maximum extent permitted by applicable law, Lexi Developers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising out of or relating to Lexi.
To the maximum extent permitted by applicable law, this includes loss of data, learning progress, opportunity, expected benefit, business, revenue, profits, or goodwill.
To the maximum extent permitted by applicable law, the aggregate liability of Lexi Developers arising from or relating to the Service will not exceed the greater of:
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, death or personal injury caused by negligence where such liability cannot lawfully be excluded, or any other liability that applicable law does not permit to be excluded or limited.
To the extent permitted by applicable law, you agree to be responsible for reasonable losses, claims, or expenses arising directly from your intentional unlawful misuse of Lexi, infringement of another person's rights through your use of Lexi, or material violation of these Terms.
This provision does not apply to the extent prohibited by mandatory consumer law.
To the maximum extent permitted by law, Lexi Developers will not be responsible for failure or delay caused by events reasonably outside their control, including failures of communications networks, internet services, app stores, hosting providers, third-party infrastructure, governmental action, natural disasters, war, civil disturbance, cyberattacks, labor disputes, or widespread technical failures.
Nothing in these Terms is intended to waive, restrict, or exclude a mandatory consumer right that cannot legally be waived, restricted, or excluded.
Where these Terms conflict with a mandatory rule of applicable consumer law, the mandatory rule will prevail only to the extent of the conflict.
If you obtained Lexi through Apple's App Store, you acknowledge that these Terms are between you and the developer responsible for Lexi, and not between you and Apple.
Apple is not responsible for Lexi or its content and has no obligation to provide maintenance or support services for Lexi.
To the extent required by Apple's applicable terms, if Lexi fails to conform to an applicable warranty that has not been validly disclaimed, you may notify Apple and Apple may refund the applicable purchase price for the application. To the maximum extent permitted by law, Apple has no other warranty obligation concerning Lexi.
The developer responsible for Lexi, rather than Apple, is responsible for addressing claims relating to Lexi or your possession or use of Lexi to the extent required by applicable law.
In the event of a third-party claim that Lexi or your possession and use of Lexi infringes intellectual-property rights, responsibility for addressing that claim rests with the developer responsible for Lexi to the extent required by applicable law, and not with Apple.
You represent that your use of Lexi complies with applicable trade sanctions and export-control restrictions and that you are not prohibited from using the Service under applicable law.
You must comply with applicable third-party agreements when using Lexi.
Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to your use of the Apple-distributed version of Lexi and, upon your acceptance of these Terms, may enforce applicable provisions against you as a third-party beneficiary.
If you obtained Lexi through Google Play, your use of Google Play and transactions processed through Google Play are also subject to Google's app-store and payment terms.
Google is not responsible for obligations undertaken by Lexi Developers under these Terms except to the extent Google expressly agrees otherwise under its own terms.
These Terms may be updated when Lexi, its functionality, technical requirements, commercial model, service providers, or applicable legal requirements change.
The effective date at the top of this page indicates the current version.
Where required by applicable law, material changes will be communicated before they become effective or consent will be requested where required.
Continued use after an updated version becomes effective may constitute acceptance where permitted by applicable law.
If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will remain effective to the maximum extent permitted by law.
A failure to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or the right to enforce it later.
To the extent permitted by law, Lexi Developers may transfer rights and obligations relating to Lexi in connection with a reorganization, acquisition, merger, sale, financing, or transfer of the Service or associated business.
Your rights under these Terms may not be transferred where the transfer would violate these Terms or applicable law.
These Terms, together with the Privacy Policy and applicable purchase terms presented through the relevant app store, constitute the terms governing your use of Lexi, except where mandatory law provides otherwise.
