Creator Program Terms

These Terms govern participation in Ten Percent Red creator campaigns, including content approval, performance-based rewards, payment, content ownership, usage rights and fraud prevention.

By submitting content to a Ten Percent Red creator campaign, you agree to these Terms. A campaign may include additional written terms. If campaign-specific terms conflict with these Terms, the campaign-specific terms control for that campaign.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement. You must provide accurate identity, contact, creator-account and payment information when requested.

Ten Percent Red may limit a campaign by country, audience location, platform, language, game, creator category or other reasonable eligibility criteria. Participation in one campaign does not guarantee access to future campaigns.

2. Campaign participation and approval

Approval means the content is accepted for the campaign. It does not guarantee that the content will reach a payout milestone.

Except for materials supplied by Ten Percent Red, you must own the submitted content and have all rights, permissions and licenses necessary for every element included in it.

Reposts, recycled videos, previously published videos, content copied from another creator, or materially reused content do not qualify unless Ten Percent Red explicitly approves the reuse in writing.

You represent that your content does not infringe copyright, trademark, privacy, publicity, music, performance or other third-party rights. You remain the owner of your original creator content; these Terms grant Ten Percent Red a license rather than transferring your copyright.

5. Performance measurement and payouts

The standard tracking period is 30 days from publication. Unless campaign-specific terms state otherwise, the following schedule applies to each approved video:

Milestones are not cumulative. Only the highest milestone reached by that individual approved post applies.

“Qualified Views” means genuine, verifiable audience views accepted by Ten Percent Red after reasonable review. Platform-reported numbers may be adjusted to exclude suspected invalid, artificial or otherwise non-qualifying activity.

Standard payouts are made through PayPal. Larger campaigns or higher-value payouts may be paid by bank wire when agreed in advance. All amounts are in U.S. dollars unless the campaign says otherwise.

6. Fraud, artificial traffic and verification

The following activity is prohibited and does not count toward Qualified Views:

Ten Percent Red may request native platform analytics, audience geography, traffic-source information or other reasonable evidence needed to verify performance. Suspicious activity may cause review, delayed payment, exclusion of views, disqualification, cancellation of payment or removal from future campaigns.

7. Required post-retention period

The approved post must remain publicly accessible throughout the 30-day tracking period and for at least 30 additional days after the later of (a) completion of the tracking period and (b) receipt of payment.

Removing, hiding, materially editing or restricting the approved post before the retention period ends is a material breach, unless Ten Percent Red approved the change in writing. Ten Percent Red may offset affected amounts against future payouts or request repayment where permitted by law.

8. Ten Percent Red rights to qualifying paid content

For content that qualifies for payment and is paid for, you grant Ten Percent Red a worldwide, perpetual, non-exclusive, royalty-free, transferable and sublicensable license to use, reproduce, repost, distribute, publicly display, publicly perform, promote and advertise the content.

The license includes the right to edit the content for format and advertising purposes, including cropping, resizing, shortening, creating excerpts, adding captions, subtitles, logos, end cards, calls to action, localization and similar adaptations, provided the edit does not intentionally misrepresent your statements.

Ten Percent Red may use qualifying paid content on its websites, social accounts, app-store pages, marketing materials and paid media. The license also covers your name, public creator handle, voice and likeness as they appear in the paid content for those uses.

Running an advertisement directly from your personal creator account through a platform-specific authorization mechanism (for example, creator-account ad authorization) may require an additional platform permission from you where the platform requires it.

To the extent permitted by applicable law, you consent to reasonable edits described above and agree not to assert moral rights in a way that prevents Ten Percent Red from exercising the license granted by this section.

9. Ten Percent Red materials

Ten Percent Red may provide gameplay footage, logos, artwork, screenshots, music, sound, promotional copy or other campaign materials. Ten Percent Red retains all rights in those materials.

You receive a limited, revocable, non-transferable right to use supplied materials only to create and publish approved campaign content. You may not sell, sublicense, separately distribute or use those materials for unrelated products or campaigns.

10. Legal and platform compliance

You are responsible for complying with applicable laws and the rules of the platform on which you publish. This includes any legally required advertising, endorsement, sponsorship or paid-partnership disclosure.

Ten Percent Red may require changes or removal if content creates a legal, platform, intellectual-property or brand-safety risk.

11. Taxes and payment information

You are responsible for taxes, declarations, registrations and similar obligations arising from payments you receive, except where Ten Percent Red is legally required to withhold or report amounts.

You must provide accurate payment information and any reasonably required tax or identity documentation. Fees charged by your payment provider or receiving bank are your responsibility unless campaign terms state otherwise.

12. Independent creator relationship

You participate as an independent creator. Nothing in these Terms creates an employment relationship, partnership, joint venture, franchise or agency relationship. You control how you produce your content subject to campaign requirements.

The Creator Program is non-exclusive unless campaign-specific terms expressly state otherwise.

13. Confidential and unreleased information

If Ten Percent Red gives you non-public game builds, unreleased features, embargoed assets, campaign plans or other information identified as confidential or reasonably understood to be confidential, you may use it only for the authorized campaign and may not disclose it before the approved release time.

14. Disqualification, termination and repayment

Ten Percent Red may reject or disqualify content, suspend participation or end access to the Creator Program for material breach, fraud, intellectual-property violations, unlawful conduct, material misrepresentation or repeated failure to follow campaign requirements.

No payout is owed for content properly disqualified before payment. If payment was made based on fraud, falsified information, lack of required rights, or a material breach of the required retention period, Ten Percent Red may request repayment or offset the affected amount against future creator payments where permitted by law.

15. Disclaimers and limitation of liability

Participation is at your own risk. Ten Percent Red does not guarantee views, reach, engagement, followers, installs, revenue, future campaigns, platform distribution, account growth or any minimum payout.

Ten Percent Red is not responsible for platform algorithms, moderation decisions, account restrictions, suspensions, takedowns, outages, reporting errors, changes to platform policies, loss of audience, loss of opportunity, creator expenses, taxes, payment-provider delays, bank fees or any action or omission of a third-party platform or service.

To the maximum extent permitted by applicable law, Ten Percent Red and its affiliates, owners, officers, employees, contractors and licensors disclaim all liability arising out of or relating to the Creator Program, any campaign, any creator content, or use of any platform or third-party service.

To the maximum extent permitted by applicable law, Ten Percent Red will not be liable for any indirect, incidental, special, exemplary, punitive or consequential damages, loss of profits, loss of revenue, loss of business, loss of data, loss of goodwill, loss of opportunity or similar losses, whether based on contract, tort, negligence, strict liability or any other legal theory, even if advised that such loss was possible.

If applicable law does not permit complete exclusion of liability, Ten Percent Red's total aggregate liability arising out of or relating to a specific creator campaign will be limited to the amount actually paid or payable to the creator for that campaign. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

16. Creator indemnity

To the extent permitted by applicable law, you will defend, indemnify and hold harmless Ten Percent Red and its applicable affiliates, officers and contractors from third-party claims arising from your breach of these Terms, your infringement of third-party rights, or unlawful content or conduct attributable to you.

17. Changes to Terms and campaign-specific terms

Ten Percent Red may update these Terms prospectively. Updated Terms will apply to future submissions after the new version becomes effective. Material changes will not retroactively reduce an already-approved video's earned payout unless required by law, necessary to address fraud, or separately agreed with you.

A campaign may specify different payout tiers, countries, platforms, tracking periods, usage rights or other conditions. Those written campaign-specific terms control if they expressly conflict with these Terms.

18. Governing law and disputes

If campaign-specific terms identify a governing law and forum, those provisions apply. Otherwise, these Terms are governed by the laws of the jurisdiction in which the applicable Ten Percent Red contracting entity is registered, without regard to conflict-of-law rules, and disputes will be brought in the competent courts for that entity's registered jurisdiction, except where mandatory applicable law requires otherwise.

19. General terms

Acceptance

By submitting content for approval or otherwise participating in a Ten Percent Red creator campaign after being provided access to these Terms, you confirm that you have read, understood and agreed to them.
